    Default Advoce on a no seat belt ticket

    Yesterday I was stopped by a police officer for not wearing the seat belt. The mistake I made was to unclick the seat belt when he puled me over, I panicked. In all honesty I was wearing it but he gave me a ticket. I didn't think I did anything wrong and forgot the seat belt law. I live in Illinois.

    He was following me and I didn't notice him till he turned on the siren. He was upset and asked me why I didn't stop when I sew him. I didn't see him, I was looking for an Estate Sale and turning my head left and right, so he thought that I was ignoring him. I am short and was wearing a bulky coat that was unzipped. I think that for that reason he didn't see me buckled when I went past him. I showed him how fast I can buckle up hoping
    he would see that I do use my seat belt.

    I can pay $55 or go to court. If I were to go to court do I stand a chance or will I have to pay the $55 plus court costs. If you know anything about this problem please give me your input.

    I'd go to court, if you have the time. This won't affect insurance, so, if you have the money, or don't have the time - then just pay.

    Well This is a different kind of court them you are thinking of. You go down to were it tells you to go and you just go up to the judge and tell her what happened and that person will decide weather you are at fault or not. I was in a car accident in 1997 and it was deemedmy fault as I was coming out of a parking lot and the other driver came over the hill doing at lest 35 in a 25. I was able to get my ticket lowered because I was sure that I was not 100% at fault. I was not against paying it but some told me to go in and tell them your side of the story as you see it and see if they will lower it and they did. All you can do is try, and I did not have to pay any court cost. Patti

    If the seat belt was off when he approached the car, he is well

    within his rights to ticket for it. You would have to be able to

    prove or make a good case for the reason why the seatbelt was undone

    when it was for the judge to dismiss it.



    Seatbelt laws are getting very strict and the police are rather

    ticket happy when it comes to it, for good reason.



    Honestly, I don't think you'd be able to argue your way out of it,

    but if you really think you might be able to, then push it to court.



    I've only ever fought one ticket, and I won, but it wasn't a ticket

    issued directly to me, it was a ticket issued through the mail based

    on what 1 person said happened, as opposed to what actually

    happened. When it came time for court, the other person

    conveinently "forgot" that anything had happened at all, and the

    ticket was dismissed.



    But fighting a direct police issued ticket is a lot harder because

    it's your word against a police officer.

    My advice is to go to court. If the policeman does not show up, (and

    you don't have a bunch of other stuff,) it is possible the ticket

    gets dismissed.

    Several years ago I was sitting at a stop sign & a police officer passed me. I turned left & he turned around & pulled me over. He asked why I did have my seatbelt on, I told him I did, he asked me again & I told him the say thing. He was getting really mad at me. But I wasn't backing down. He told me no I didn't & then he said my daughter didn't have a seatbelt on either. He gave me a ticket for no seatbelt but he didn't give me a ticket for my daughter (she had a seatbelt on) He was a big jerk. That was all he did, give people tickets for no seatbelt. I wasn't about to pay for a ticket over something I didn't do. I went to a no seatbelt class. They showed filmson wrecked car & told stories about people that didn't wear a seatbelt. Guess who the instructor was???? The policeman that gave me the ticket. I would go to court.

    My brother in law , just went to court, he's a law abiding person and

    could seeing the car was just around corner , but didn't quite get all

    way in other lane. The police do not have to show up at court. They

    just read off the charges.So it cost my sister and him a lot, both took

    off work part of day,court costs , fine, points on license, plus

    getting points on license can make insurance go up. So this is what it

    Default Advoce on a no seat belt ticket

    Take it to court. It's free, and if he doesn't show up, you

    automatically win. My hsuband has gotten out of several tickets like

    that. Also, if you are willing to take it to court, sometimes the

    judge will even lower the fine.
